Welcome to THE OBAMA TIME CAPSULE website (the “Site”), a service of Against All Odds Productions, Inc. (“Against All Odds Productions”). By visiting the Site, you accept these Terms of Use. This is a legally binding agreement between you and Against All Odds Productions; please read it.

Against All Odds Productions respects your privacy. Please take moment to review our privacy policy.

The Web is an evolving medium. Against All Odds Productions may change the terms of this agreement from time to time. By continuing to use this website following our posting of such changes, you agree to be bound by this agreement, as modified. Against All Odds Productions may change, restrict access to, suspend, or discontinue this website, or any portion of this website, at any time.

Creating a Personalized Book: You are responsible for the quality of any photos, artwork, or text you submit

Our How to Make a Book describes how to create your Personalized Book. Our Help page answers common questions about the process and how to track your order. Please read them.

We use an automated process to print your Personalized Book. Our automated process allows you to manipulate the photo(s) you’ve uploaded and to review how the photo(s) and artwork will look in your Personalized Book before you submit your book for publication. But we don’t review your photo(s) or artwork or assess how they will look in your Personalized Book. We don’t review the text you submit, and can’t confirm that you’ve properly spelled the name of the person for whom you’re creating the Personalized Book. And we can’t fix any flaws in your photo(s) or artwork or correct typographical or grammatical errors in your text. If the photo(s) you upload are out of focus, fuzzy, or grainy, or too light or too dark, or have other defects, or if the people depicted in the photo(s) have “red eye,” your Personalized Book will have the same flaws. If you misspell a name or word, that name or word will be misspelled in your Personalized Book.

Our quality meter will give you a rough idea of whether your photograph is of high enough resolution to reproduce adequately in a Personalized Book. If your photo isn’t at least 1024 pixels by 1024 pixels, it will appear fuzzy or blurry when printed in a Personalized Book. You’ll need at least a 2-megapixel camera to take a photo this size. The higher the resolution of your photo, the crisper it will look when blown up in your Personalized Book. But a high-resolution photograph isn’t necessarily a good photograph. Our quality meter won’t tell you whether your photo will look good in a Personalized Book. It will tell you only whether your photo is of high enough resolution to blow up large enough for use in a Personalized Book. Only your eye can tell you whether your photo will look good in a Personalized Book. Before you press the button labeled “Publish My Book,” you should take advantage of the opportunity we give you to review your photo(s), artwork, and text as they will appear in your Personalized Book. Once you press the button labeled “Publish My Book,” there’s nothing we (or you) can do to make your Personalized Book look or read better.

We charge your credit card when you place your order; we can’t accept returns

Personalized Books are custom orders. We print your Personalized Book in response to your instruction to “Publish My Book” and use the photo(s), artwork, and text you’ve submitted. We can’t sell your Personalized Book to another customer if you decide that you don’t want it. Amazon will charge your credit card for the complete cost of your order (your Personalized Book of THE OBAMA TIME CAPSULE, plus shipping and handling) as soon as we tell them we’ve shipped your Personalized Book. And since each Personalized Book is a custom order, we can’t accept returns.

Ownership and Permissions

By uploading a photo, artwork, or text (collectively, “Content”) to our servers to be used in a Personalized Book, you represent and warrant that you own copyright in the Content or have explicit permission from the copyright owner to use the Content in your Personalized Book. You agree to indemnify Against All Odds Productions and its owners, employees, and representatives and to hold them harmless from any suit, demand, or claim made against them (or any of them) claiming that use of any of the Content you submitted in a Personalized Book infringes someone else’s rights in that Content. You agree to pay any judgment or any reasonable settlement resulting from any such suit, demand, or claim, and to pay all reasonable attorneys’ fees incurred by Against All Odds Productions (and/or its owners, employees, or representatives) in defending against such suit, demand, or claim.

By uploading Content, you authorize us to print that Content in a full-color book for your own personal use. You may not use your Personalized Book for promotional or commercial purposes without prior written approval from Against All Odds Productions.

From time to time, we may use a limited number of Personalized Books (or portions of Personalized Books) created from Content submitted by our customers to demonstrate, promote, and/or publicize our service. By submitting Content for use in a Personalized Book, you agree to this use. We may also consider Content you submit for other use by Against All Odds Productions. If, however, we want to use Content submitted by you for another book or for any other product produced by Against All Odds Productions, we will contact you and ask for your written permission in advance of any such use.

This website is made available for your personal, noncommercial use only. The materials on this Site are the property of Against All Odds or its licensors, and are protected by U.S. copyright laws, other copyright laws, and international conventions. You may display and occasionally print a single copy of any page on the Site for your personal, noncommercial use but, except as explicitly provided in this agreement, you may not distribute, transmit, display, reproduce, modify, create derivative works from, or otherwise exploit any of the materials on this Site. You may not store any significant portion of, nor distribute copies of, materials found on this Site in any form (including electronic form) without prior written permission from the owner. You are free to establish a hypertext link to this Site so long as the link does not state or imply any endorsement or sponsorship of you, your company, or your site by Against All Odds. To the full extent permissible by applicable law, Against All Odds Productions disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant that this Site or email sent from Against All Odds Productions is free of viruses or other harmful components. Against All Odds Productions will not be liable for any indirect, incidental, punitive, or consequential damages arising from use of this Site or from any products made available to you through this Site. Some state laws do not allow limitations of implied warranties or exclusion or limitation of some damages. Disputes

These Terms of Use have been entered into in, and will be construed in accordance with the laws of, the State of California. By using this Site, you consent to the exclusive jurisdiction and venue of the state and federal courts in San Francisco County, California, in all disputes arising out of or relating to these Terms of Use, our Privacy Policy, this Site, or your Personalized Book.
